SPECIAL CONTRACTUAL TERMS AND CONDITIONS FOR THE RAMMSTEIN CONCERTS

The purchase and use of a concert ticket, as well as participation in the event scheduled at the Ušće Park in Belgrade, implies agreement with the Organizer’s regulations for attending the event.

DEFINITIONS

Event

The definition of “Event” includes, but is not limited to: music concerts, dance or theater performances, festivals, sports events, exhibitions, fairs and all other public events related to the above, for which public entrance is conditional upon the purchase of a ticket. In the context of this document, this expression specifically refers to the Rammstein concert that will take place at the Usće Park in Belgrade.

Ticket

The civil contract between the Event Organizer and the Customer, in written or electronic form, with unique identifiers, aims to enable attendance at the Event indicated on the Ticket. A person who is a user (or owns a Ticket) confirms his right to attend the Event through that Ticket. In the context of this document, this term refers to the Rammstein concert that will take place at the Ušće Park in Belgrade.

E-Ticket

A special electronic ticket issued via web portal or an application that allows the storage and transfer of tickets to digital devices, printing on paper by the Customer or the owner as needed and verification at the venue using digital devices.

Buyer

The person who buys the ticket (E-ticket), regardless of the name of the person to whom the fiscal invoice or invoice generated by the purchase was issued. For the purposes of this provision, the term “Customer” is understood to include the Owner and the Visitor, the provision being understood exclusively in the case of the latter two persons or also applicable to them. This provision also applies to the legal entity of the Buyer, except for those provisions which by their nature can be applied exclusively to a natural person.

Vendor

The legal entity that concluded the contract for the sale of tickets for the event with the Organizer of the event is the official distributor of tickets for the event through the webshop and mobile application. For the purposes of this document, the Seller is EFINITX D.O.O. BELGRADE (hereinafter referred to as EFINITIX) Dimitrija Tucovica 10, Belgrade, ID number: 17242628, VAT reg. number: 100835855

Webshop

A service that operates on internet platform where the Seller sells tickets provided by the Event Organizer. For the purposes of this document, the terms www.efinity.rs and eFinity app will be understood as Webshop.

The Owner or Holder of the ticket

A natural person who actually owns a ticket that entitles him/her to attend the event.

Visitor

An individual attending or intending to attend a ticketed event.

Purchasing transaction

The process initiated by the Buyer, in accordance with the Buyer’s will, in the web portal or the Seller’s mobile application for the purchase of certain tickets, in which the exact nature of the tickets to be purchased (event, ticket categories, ticket price), the selected method of payment and ticket issuance is determined , as well as data related to the Customer and the actual Visitor, the value of the paid ticket and system fees are clearly recorded.

Event organiser

The party solely responsible for the Event as a service for which the ticket is used and the responsible holder of the ticket sales participation fee. For the purposes of this document, the organizer of the event is SKYMEDIA GROUP D.O.O.

THE CONDITIONS FOR USING TICKETS AND VISITING THE EVENT

  1. The resale of tickets for commercial purposes purchased for the event and the sale of tickets for private needs are prohibited.
  2. The ticket entitles the ticket holder to one entry to the Event.
  3. The Event Organizer has the right to use subcontractors to carry out suitability and security checks.
  4. The event is not open to children under the age of 6. Children aged 6-16 must have a valid full price ticket and be accompanied by an adult.
  5. Visitors are subject to the rules of the current house rules at the Event venue, i.e. in Ušće Park, during the Event. The current version of the house rules will be displayed on the website of the Organizer (https://skymedia.rs/en/events/rammstein-belgrade2024/) and at the venue of the event.
  6. Visitors, ticket holders expressly accept that during the Event visual and/or audio material such as photographs, film, TV and/or sound recordings (hereinafter referred to as “Recordings”) of the Visitor (ticket holder) will be recorded by Rammstein Konzert GmbH (Hertzstraße 63 B, 13158 Berlin, hereinafter “Rammstein”) and/or third parties commissioned by Rammstein for this purpose during the Event. By purchasing a ticket, the Visitor (ticket holder) agrees that he/she may be recorded by Rammstein Konzert GmbH or the Rammstein band, without any restrictions as to space, time or content, edited or unedited, in whole or in part, on physical or non-physical media/storage devices, in any medium and format (eg, but not limited to print, social, audiovisual or online media), and any such recording may be used alone and/or through third parties, may reproduce, distribute, broadcast, make publicly available and available without any restriction or compensation.
  7. The Visitor (Ticket Holder) accepts that it is the responsibility and obligation of the Visitor (Ticket Holder) to become familiar with and comply with applicable laws, regulations and rules regarding entry and entry to and participation in the Event. Failure to comply with these laws, regulations and rules may result in the Ticket Holder being denied entry or removed from the Event. No compensation will be payable to the ticket holder or visitor for such exclusion or ejection.

FINAL AND MISCELLANEOUS PROVISIONS

  1. The Visitor (Ticket Holder) declares that he/she is aware that the Event Organizer excludes all liability for any risk, danger, injury or death that may arise in connection with his/her arrival or departure from the Event, excluding any event that takes place at the scene.
  2. Similarly, the Event Organizer excludes liability in the case of visitors (ticket holders) aged 6-16 years if risk, danger, injury or death results from non-compliance or violation of the duty of supervision by an adult accompanying a child of that age (6-16 years) .
  3. Visitor (Ticket Holder) – in the case of 6-16 years old, the adult guardian confirms that he is attending an event where visitors are exposed to a high level of musical noise, heat and light and therefore the Event Organizer expressly excludes any responsibility for any damage caused by these effects (whether for auditory, nervous, visual or other sensory systems).
  4. The Visitor acknowledges that the productions and performances presented during the Event are protected by copyright and performance rights, therefore, in accordance with the applicable provisions on copyright and related rights, the use of cameras and/or sound recording devices is strictly prohibited in that area of ​​the Event and during for the entire duration of the Event without the prior written permission of the Rights Holders, as well as taking pictures and/or sound recordings of the Event, including the performances of any opening bands. The Organizer of the event will publish a special notice on the grant of recording rights and will post it at the venue of the event. Otherwise, the right will not be considered granted. If such material is recorded, the Event Organizer has the right to require any person who violates this rule to destroy the recording, to immediately stop the action and to refuse entry to the event or to require the offender to leave the event without any obligation to pay compensation, compensation or other compensation of this kind, or refund or reimbursement of the price of the ticket or its specific part.
  5. In case of non-attendance at the Event itself, tickets will not be refunded.
  6. The start or gate opening time shown on the ticket is indicative and the actual start of the Event or entrance to the Event may not be significantly different. For certain Events, the start time shown is the start time of the main act, and any opening bands or other supporting events may take place before the start time shown on the ticket.
  7. Upon entry, the Event Organizer may, through the Event security service, in addition to checking the authenticity and validity of the ticket, also check the clothing and luggage of persons entering the Event. This check is for the safety of event visitors. Entry to the event may be refused until the person waiting to be admitted can show a valid ticket or until staff conducting admissions refuse entry to the person waiting to be admitted, giving appropriate reasons.
  8. No food, drink, open or unopened liquid bottles, cans, cans, bottles, plastic bottles, umbrellas, bags larger than A/4, any piercing or cutting tool, selfie sticks, food containers, sound recording devices, laser pointers, laptops, go-pro cameras, cameras, video cameras, drugs, explosives, weapons, chains or any other item that the Event Organizer considers to be dangerous to the audience or the conduct of the Event.
  9. The visitor is obliged to keep the ticket with him and, upon request, hand it over to an authorized person for inspection, as long as he stays at the event. The Visitor acknowledges that certain tickets may only be valid for certain areas within the event area.
  10. The seating ticket gives the visitor the right to stay in the stands during the performance only and exclusively in the place indicated on the ticket.
  11. Visitors must be in their seats no later than ten minutes before the start of the Event. In order to ensure the smooth flow of the Event, the Event Organizer may restrict the movement of the Visitor.
  12. Everyone attends the Event at their own risk. Although the Event Organizer will do its best to facilitate the safe conduct of the Event, the Event Organizer can not be held responsible for any irresponsible behavior of Visitors. Such incidents must be reported immediately by the visitor to the on-site security service.
  13. The event is not open to visitors under the influence of alcohol, drugs or other psychoactive substances, even if they present a valid ticket. No compensation or compensation shall be paid to the visitor (ticket holder) for such exclusion.
  14. The Organizer of the Event may remove any Visitor (Ticket Holder) who ignores or grossly violates the conditions of participation, the rules of the Event or the house rules of the venue of the Event, the instructions of the security service and other law enforcement authorities, in order to ensure the safe conduct of the Event and the smooth entertainment of all visitors present at the Event. The Organizer of the event is not obliged to pay any compensation in case of exclusion for the above reasons.
  15. It is strictly forbidden to interfere with the performance, to disturb the artists and collaborators in any way, to compromise or prevent their work. The organizer of the event will immediately ask the Visitor who behaves like this to stop his activity. Any Visitor who continues to behave inappropriately or commits a serious offense despite a warning will be immediately removed from the venue by the Event Organizer. No compensation shall be paid to the Visitor for such exclusion.
  16. The Event Organizer reserves the right to make minor and/or justified changes to the performers, cast, players, performance, start time or other parameters of the Event and excludes any liability for damage caused by such changes.
  17. The Event will take place even in case of rain.
  18. The Event will be considered to have taken place even if it is interrupted, terminated early or postponed due to weather conditions, provided that:
  19. a) More than half of the Event was held
  20. b) The start of the Event is delayed by less than fifty percent (50%) of the scheduled duration of the event;
  21. c) If the Event is interrupted for less than twenty-five percent (25%) of the scheduled duration of the event.
  22. If the Event is suspended, the Event Organizer will try to create the necessary conditions for the safe waiting of Visitors, but will not be responsible for any failure.
  23. In the event of cancellation of the Event, the Event Organizer will immediately inform the Customers through a notification on how to return the tickets and how to get a refund. The notice will contain all the relevant details of the canceled event, the fact and reason for the cancellation, the method of refunding the tickets, as well as the contact person who will refund the tickets.

GENERAL TERMS OF USE OF THE EFINITY MOBILE APPLICATION AND WEB PORTAL

  1. Company EFINITIX DOO BELGRADE (hereinafter EFINITIX) Dimitrija Tucovica 10, Belgrade, ID number: 17242628, VAT reg. number: 100835855, is the owner and issuer of the eFinity Mobile Application on Android and iOS mobile platforms (hereinafter eFinity Application) as well as eFinity WEB Portal https://www.efinity.rs/ (hereinafter eFinity WEB Portal).
  2. Any person who is an eFinity User agrees to the General Terms of Use of the eFinity Service and may use all functions of the eFinity Service mobile application and eFinity WEB Portal.
  3. EFINITIX company has the right to collect, use, process all data collected within the eFinity Service, or related eFinity Applications, which are an integral part of the General Terms of Use of the eFinity Service. EFINITIX company undertakes to keep personal data on eFinity Service Users, as well as data on transactions in accordance with the Law on Personal Data Protection (“Official Gazette of RS”, No. 87/2018) (hereinafter the Law), i.e. used exclusively for the needs of eFinity Service and eFinity Users, in accordance with the positive regulations of the Republic of Serbia.

EFINITIX company collects only the necessary, basic data on the eFinity Application customers / Users and the data necessary for business and informing Users in accordance with good business practices and in order to provide quality service. EFINITIX company gives customers a choice including the ability to decide whether or not to delete themselves from the mailing lists used for marketing campaigns. All information about the eFinity Application Users / customers is strictly kept and is available only to employees who need this information to do their job. All employees of EFINITIX company (and business partners) are responsible for respecting the principles of privacy.

When entering payment card data, confidential information is transmitted via the public network in a protected (encrypted) form using SSL protocols and PKI systems, as currently the most modern cryptographic technology. Data security during the purchase is guaranteed by the payment card processor, Banca Intesa ad Belgrade, so the complete billing process is performed on the bank’s website. At no time is payment card information available to our system. EFINITIX company undertakes not to archive, in any electronic form, the data downloaded from the eFinity Application User related to the payment card with which the transaction is realized, especially the card number, expiration date, CVC2 and CVV number, etc.

In case of return of goods and return of funds to the customer who previously paid with one of the payment cards, in part or in full, regardless of the reason for return, EFINITIX company is obliged to return only through VISA, EC / MC and Maestro payment methods, which means that the bank will refund the funds to the cardholder’s account at the seller’s request.

  1. The data controller for data obtained on the basis of the eFinity Service use, i.e. the eFinity Application and the eFinity WEB Portal, in accordance with the above-mentioned Personal Data Protection Act, is Telekom Srbija, and the Data Processor is EFINITIX company. Telekom Srbija has the exclusive right to sell the eFinity application service (hereinafter eFinity Service), for the needs of its end Users, legal entities registered in the Republic of Serbia (hereinafter eFinity User).
  2. Data Users for data obtained on the basis of using the eFinity Mobile Application Service and eFinity WEB Portal, in accordance with the above-mentioned Law on Personal Data Protection, are eFinity Users who have an adequate Agreement on the use of eFinity Services with Telekom Srbija.
  3. EFINITIX company reserves the right to withdraw the eFinity Service mobile application and / or the eFinity WEB Portal from use at any time and without further notice, as well as to partially and / or completely change the General Terms of Use of the eFinity Service, with the obligation to give such notice in writing on the website http://www.efinity.rs and within the eFinity Mobile Application Service itself.
  4. The eFinity Application and eFinity WEB Portal can only be used by a registered eFinity Service User. EFINITIX reserves the right to, at any time, verify the identity of the eFinity Service User through Telekom Srbija, which has the eFinity User registration data.
  5. The eFinity Service User may at any time revoke the consent for data processing that is performed without a legal basis, in writing or orally on the record, and that he is obliged to reimburse the Data Controller for justified costs and damages, in accordance with the regulations of the Republic of Serbia governing liability for damage.
  6. The Controller, Processor and User of the eFinity Service User data are subject to misdemeanor liability if they process data that is not allowed in accordance with the positive regulations of the Republic of Serbia.
  7. The eFinity Service User agrees that the EFINITIX company can use all data contained within the eFinity Applications (Android and / or iOS), i.e. obtained through the eFinity WEB portal, in accordance with the Law and positive regulations of the Republic of Serbia, for the analysis of collected data, and delivery of content via eFinity WEB Portal and eFinity Applications, i.e. providing additional services to eFinity Users of eFinity WEB Portal and eFinity Applications.
  8. eFinity Service Users who have not had any transactions within the eFinity Service for a period of 6 months may be temporarily suspended, i.e. such eFinity Service Users can be re-included in the eFinity Service only upon a written request sent to office@efinity.rs.
  9. The eFinity Service User can report any remark / suggestion by sending an e-mail to office@efinity.rs.
  10. Any unauthorized use, attempted reverse engineering or misuse of the eFinity WEB Portal and / or eFinity Application will be sanctioned in accordance with the Legal Acts and entails permanent revocation of the right to use the eFinity WEB Portal and / or eFinity Application.
  11. When installing each new version of the eFinity Application, the eFinity Service User will receive clear information on the necessary rights and consents of the use of mobile phone, i.e. related parts of the phone (GPS sensor, etc.) which must be explicitly accepted by the eFinity Service Application User.
  12. The eFinity Service User may, at any time, request the change of personal data previously submitted within the eFinity WEB Portal and / or the eFinity Application via the eFinity WEB Portal and / or the eFinity Application, or via a written statement.
